What is a Grant of Probate?

The Grant of Probate certificate is a useful document for anyone who is going to be managing the affairs of someone who has recently died.

This certificate assigns you as the executor of an individual’s will, so you can manage the recently deceased person’s property, finances, and possessions. You can even manage overseas properties with a Grant of Probate.

How to get a Grant of Probate

To apply for a Grant of Probate, you will first need to be named as an executor in the deceased’s will. In the event that there is no will, then the recently deceased’s closest living relative can apply instead, but they will need a Grant of Letters of Administration.

If there is a will, then the executor will need to deal with any Inheritance Tax issues that arise. Inheritance Tax will need to be paid for estates valued at £325,000 or more. However, even if the estate is valued at an amount below this, you will still need to complete the Inheritance Tax forms.

Once Inheritance Tax has been dealt with, you can apply for a Grant of Probate. This involves having to complete several different forms. You can either apply online, or through paper forms.

To apply, you will need the deceased’s death certificate, your Inheritance Tax forms, and the original will. If the death certificate is not in English, then you will need to get a translation made.
