Our Deed of gift notarisation services

To officially transfer an asset, money or other high-value gift to another person, it is important for you to create a deed of gift. This document is vital for protecting both your interests and those of the recipient. In addition, there are times a third-party, such as a financial or government authority, may specifically ask you to make a deed of gift.

As deeds of gift deal with expensive assets, it is important that they are drafted to be as accurate as possible, and are prepared with care. Then, if it is to be used abroad, the deed of gift will have to be notarised and legalised so it will be accepted by the authorities of the country you want to go to.

When might I need a deed of gift?

You, the donor, may need to make a deed of gift to give someone (the receiver/donee) an asset in the following situations:

  • Inheritance planning: The process of transferring assets to your heirs is greatly simplified with a deed of gift, as you can do it before you pass away.
  • Avoiding inheritance conflicts: Transferring ownership before you pass also avoids any potential conflicts that could arise between heirs over legal ownership.
  • Supporting family members: Children or other family members can be given property through a deed of gift to help them get a home.

What is included in a deed of gift?

A deed of gift should include information about both the donor and the recipient, as well as the details of the gift.

A breakdown of what one should include is:

  • Full details of the donor
  • Full details of the donee/recipient
  • Description of the gift
  • Date the gift is to be transferred on
  • Declaration that the gift is absolute and irrevocable
  • Confirmation the gift is to be made without consideration
  • Any conditions or restrictions (within reason)
  • Signature of the donor
  • Witness’ signature

Who can act as a witness to the signing of a deed of gift?

Many types of people can act as a witness to the donor and recipient signing the deed of gift. Typically, any witnesses must be over 18, and have no personal interest in the deed’s content.

It is best to find someone who is an acquaintance or a professional, so they are as independent from you as possible. If you know you will need to get your deed of gift notarised, you can have the notary witness it for you as well, to save you time and money.

Why you may need a notary like us

As we have previously mentioned, you may need a notary if you plan on taking your deed of gift abroad.

The notarisation of documents is something that only a notary can do, and is a necessary step for them to be valid for use overseas. A notary such as ours will provide your documents with their signature, seal, and stamp to prove that your deed of gift has been checked.

After your deed of gift has been notarised, it will then need to be legalised. This process proves that the notary’s details are real, and gives your document equal legal weight to ones made in your destination country. Most countries accept apostilles as a way to legalise documents, though some require embassy or consulate legalisation. Regardless of the process needed, we can handle both for you.

If your deed of gift is intended for use somewhere that does not use English, then you will need to have it translated into the official language of that country. This is something that we can arrange for you.
